By relaying this message covertly (and in spite of a "pointed request" by the Obama administration to avoid sending mixed signals to foreign officials), the Trump team negated the message being sent by the United States to Russia - and effectively put its stamp of approval on Russia's efforts. The question of whether Trump obstructed the investigation does not rise or fall on whether Trump knew that Flynn had committed a crime (in theory, one could impede an investigation to prevent the FBI from finding out whether there was a crime).

Flynn is cooperating with special counsel Robert Mueller's wide-ranging investigation into Russian attempts to influence the 2016 US election and potential collusion by Trump aides.

While many Republicans called for Moore to drop out of the race after several women came out with their stories, Trump has defended him, saying that Moore denied the accounts and deserved to be heard.

CNN justice correspondent Shimon Prokupecz acknowledged Monday it has not been firmly established that Trump knew the FBI concluded Flynn had lied and that Yates "wouldn't specifically get into what was said" during the agents' interview with Flynn. He has pled guilty to those lies.

"I think if Congress ever were to charge him with obstruction of justice for exercising his constitutional authority under Article II, we'd have a constitutional crisis". Of the cases I was involved with, the only time a PNG was approved was when allowing the spy to remain would have resulted in actual physical harm to a U.S. person.

On Saturday, President Donald Trump appeared to tweet what some characterized as a self-incriminating admission of obstructing justice.

Electronic records show Peter Strzok, who led the investigation of Hillary Clinton's private email server as the No. 2 official in the counterintelligence division, changed Comey's earlier draft language describing Clinton's actions as "grossly negligent" to "extremely careless", the sources said.

Trump on Monday also offered a strong endorsement of Roy Moore, the Republican Senate candidate in Alabama embroiled in accusations that he had inappropriate sexual relations with underage girls. Comey refused, and Trump fired him, too.

"They always choose the more sinister explanation for anything involving Trump", said Noyes.

The Obama administration announced new sanctions against Russia as punishment for the Kremlin's campaign to interfere in the 2016 election.

The matter is significant because, as my column contends, Special Counsel Mueller's investigation is essentially an obstruction probe.

Such a request to an FBI director has been described as obstruction of justice by some legal scholars.

"So it won't be long before we understand, one way or the other, whether Trump people colluded with Russia because I can't imagine it happening and Flynn not know about it", added the senator from South Carolina. "The president's at war with the FBI, the FBI's at war with the president, the president's at war with parts of the DOJ".

Dowd, who says he drafted Trump's Saturday tweet about Flynn, also declared: "The tweet did not admit obstruction".

"My take is that the idea that Dowd should be disbarred is nonsense". "And we then walked through with Mr. McGahn essentially why we were telling them about this and the first thing we did was to explain to Mr. McGahn that the underlying conduct that General Flynn had engaged in was problematic, in and of itself".

Knowing all this, it is very difficult to understand Dowd's tweet.
